Driving otherwise than in accordance with a licence

It is an offence to drive on a road a motor vehicle otherwise than in accordance with a licence to drive a vehicle of that class.

There are specific provisions relating to learner drivers (such as displaying the necessary 'L' plates and being supervised). Failure to comply with these requirements can lead to an offence under this section.

Technical issues may arise on whether it can actually be said that you 'drove' or 'attempted to drive'. Another technical issue may be whether you drove on a 'road'.

Endorsement can be avoided if there were 'special reasons' for driving otherwise than in accordance with a licence.

Penalty: The offence carries between 3 and 6 penalty points. Disqualification may be considered.

As well as penalty points or a disqualification, the court will also consider a fine (to a maximum of 1,000.00).
