Driving whilst disqualified (DWD)

It is an offence to drive a motor vehicle on a road when disqualified from holding or obtaining a driving licence.

The prosecution must prove that you were driving and that there is a record of disqualification for the material time which relates to you.

Penalty: The courts treat offences under this section very seriously. Disqualification from driving is discretionary. 6 penalty points can be imposed.

The court will also consider a fine (maximum £5,000.00), community penalty or custodial sentence (imprisonment) of up to 6 months.

Imprisonment is frequently imposed for DWD offences. It is therefore crucial to contact our motoring law team who will advise you on the best way to proceed and can also represent you at all stages.
