Driving Without a Licence

In accordance with Section 87 of the 1988 Road Traffic Act:

(1) It is an offence for a person to drive on a road a motor vehicle of any class otherwise than in accordance with a licence authorising him to drive a motor vehicle of that class.

(2) It is an offence for a person to cause or permit another person to drive on a road a motor vehicle of any class otherwise than in accordance with a licence authorising that other person to drive a motor vehicle of that class

Defence cases include:
 
  • A valid licence was held.
  •  The vehicle was not being driven at the material time, as alleged.
  • The vehicle was not being driven on a road.
Special reasons’, may also exist, for example a genuine emergency where no other option was available.

Penalty:
Maximum fine: £1,000
3-6 penalty points or disqualification from driving.
